SCLVN attended and shared at Seminar “The 2023 Bidding Law: Expectations and Challenges in Implementation in the Field of Construction Investment”

On May 31, 2024, in Da Nang city, Mr. Nguyen Nam Trung, Chair of SCLVN, attended and provided a speech at the seminar: “The 2023 Bidding Law: Expectations and Challenges in Implementation in the Field of Construction Investment.”

The seminar was jointly organized by the Journal of Law and Development, the Public Procurement Agency of the Ministry of Planning and Investment, and the Vietnam Law Newspaper, with the participation of many Vietnamese legal experts.

At the seminar, Mr. Trung shared about the application of the 2023 Bidding Law to construction investment projects that involving FIDIC form of contracts, including the following key points:

  1. The 2023 Bidding Law has lifted the mandatory application of lump-sum contracts.
  2. The 2023 Bidding Law has introduced new types of contracts, including Cost-Plus-Fee Contracts and Mixed Contracts.
  3. The 2023 Bidding Law has added provisions for cases where contract amendments are not required when there are changes in contract prices.
  4. The 2023 Bidding Law has abolished the restriction on the adjustment of lump-sum contract prices.
  5. The 2023 Bidding Law has clarified the selection of members for the dispute resolution board without going through the bidding process.
