On Saturday March 2nd, SCLVN started serier of webinars for members with key Speaker – Mr.Hieu Nguyen, on Unjust Enrichment in Mann v Paterson Construction Pty Ltd (2019) .
The webinar has two parts. First, it introduced the case of Mann v Paterson and the underlying restitutionary claims in the context of a construction dispute. Secondly, the talk compared the way in which Vietnamese lawyers might deal with similar questions raised in Mann. To this end, it explored several legal frameworks surrounding restitutionary claims in construction disputes under the law of Vietnam. The talk briefly delved into the key legal principles governing such claims, including the types of restitutionary claims that may arise in the context of construction disputes, the evidentiary requirements for proving such claims, and the remedies available to parties in the event of successful non-contractual claims. It aslo analyded two cases decided by the provincial Courts of Appeal in Vietnam. Through a brief analysis of relevant legal provisions and case law, this seminar provided insights into the legal landscape of construction disputes in Vietnam, highlighting the key considerations and challenges that parties may face when pursuing non-contractual restitutionary claims in such disputes.
