Learning Outcomes:

This training course is designed to equip participants with the confidence and competence to serve as Dispute Board (DB) members. By the end of the course, participants will be able to:

This course is designed to equip participants with the essential skills to effectively serve as members of a Dispute Avoidance and Adjudication Board (DAB/DAAB) under the FIDIC 1999 and 2017 contract forms. Emphasis is placed on the dual function of dispute avoidance and resolution, with particular focus on drafting clear, well-reasoned non-binding opinions and binding decisions in line with FIDIC standards and procedures.

Building on FIDIC’s expanded use of standing DAABs -now embedded across all three 2017 contract forms – this training explores the legal, procedural, and project management aspects of acting as a DAAB member. Participants will work through real case studies, complete practical assignments, and engage in best practice exchanges with expert trainers. The course is firmly rooted in the 2017 FIDIC Forms, while also highlighting key changes from the 1999 Conditions, especially in relation to DAB/DAAB provisions.

Beyond the Protocol: India’s Divergent Approach to Delay and Disruption Analysis in Construction Arbitration

Ajit Kumar Mishra is a prominent figure in the dispute resolution field, particularly in the context of construction and infrastructure projects. He is currently serving as as a board member as Director (Works) in IRCON International Ltd, a central public sector entity executing infrastructure projects in over 25 countries. Prior to this posting he had been heading Contract Management Division for a USD 12 billion World Bank / JICA funded infrastructure project in India.
Mr Ajit Kumar Mishra has a strong background in engineering, management, and law, holding a B.Tech. in Civil Engineering, an LLM in International Dispute Resolution, an MBA in International Business, and a Diploma in International Arbitration. He is a Fellow of the Chartered Institute of Arbitrators (FCIArb), Fellow of Prime Dispute (UK) and has been member of UK Adjudicators, Dispute Resolution Board Foundation.
He has over 30 years of professional work experience in the field of Project Management, International Procurement, Contract Management, Risk Management, Infrastructure Financing and Dispute Resolution for large infrastructure project.
He is a FIDIC Certified Adjudicator and is listed on the FIDIC President’s List of Approved Dispute Adjudicators. He also holds a FIDIC Certified Trainer credential, which underscores his authority to train others in FIDIC contract methodologies.

Nguyen Nam Trung

Trung has more than 20 years of experiences in construction industries: commercial, industrial and infrastructure projects. In particular, he has deep knowledge in power projects with EPC/Turnkey contracts.
He is FIDIC Certified Trainer on Fundamental Contracts and Silver Book (EPC/Turnkey), and Member of Writing Committee and Examination Committee, FIDIC Certified Contract Manager (FCCM) programme.

Trung has been enlisted to the Panels of Arbitrators in Brunei Darussalam (BDAC), China (BAC/BIAC), Malaysia (AIAC), Myanmar (MIAC), Japan (JACC), Thailand (THAC), and Vietnam (VIAC).
He has experience as Chair of Dispute Adjudication Board (DAB) in power projects, has been certified by FCL as FIDIC Certified Adjudicator, and listed on FIDIC President’s List of Approved Dispute Adjudicators.

This course is designed to equip participants with the essential skills to effectively serve as members of a Dispute Avoidance and Adjudication Board (DAB/DAAB) under the FIDIC 1999 and 2017 contract forms. Emphasis is placed on the dual function of dispute avoidance and resolution, with particular focus on drafting clear, well-reasoned non-binding opinions and binding decisions in line with FIDIC standards and procedures.

Building on FIDIC’s expanded use of standing DAABs -now embedded across all three 2017 contract forms – this training explores the legal, procedural, and project management aspects of acting as a DAAB member. Participants will work through real case studies, complete practical assignments, and engage in best practice exchanges with expert trainers. The course is firmly rooted in the 2017 FIDIC Forms, while also highlighting key changes from the 1999 Conditions, especially in relation to DAB/DAAB provisions.
